License Agreement

Platform Purpose

Galleria Art is an art platform that exists to showcase artists and their artworks. Galleria Art does not participate in the sale or purchase of artworks. Our platform's purpose is only to facilitate connections between artists and potential collectors. We do not take part in, mediate, or assume responsibility for any transactions conducted outside the platform.

Artist Intellectual Property

Artists retain all right, title, and interest in and to the original artwork they upload to Galleria Art. Nothing in this License Agreement transfers ownership of artist content to Pllay. Reproduction, modification, distribution, or commercial use of an artist's work — by Pllay, by other users, or by third parties — is prohibited without the artist's explicit written consent, except for the limited operational license granted to Pllay under the Platform Content License section below. Pllay does not claim any ownership interest in user-uploaded artwork.

Platform Content License

By uploading content to Galleria Art, you grant Pllay a limited, non-exclusive, royalty-free license to display, reproduce, transmit, and promote the artwork solely for the purpose of operating and marketing the platform. This license expressly includes the use of your artwork as input to artificial intelligence and automated systems we operate, or have a third party operate on our behalf, for the purposes of:

  • generating descriptions, embeddings, color palettes, and tags;
  • automated moderation for compliance with our Community Guidelines and Copyright Policy;
  • clustering and inclusion in AI-generated themed virtual galleries; and
  • discovery, search, and recommendation features.

The license does not include the use of your work to train any artificial intelligence model, whether ours or a third party's. The license terminates when you remove the content from the platform; AI-generated derivatives that incorporate or describe the removed content (such as virtual galleries) will be regenerated or removed within a reasonable period after removal.

Transactions & Pricing

Any price tags displayed on the platform are suggested prices provided by the artists. The final price and any transaction terms must be negotiated directly with the artist or the artist's authorized representative. Galleria Art is not a party to any transaction and assumes no responsibility for payments, deliveries, or disputes arising from deals made outside the platform.

Identity & Verification

Galleria Art does not guarantee or verify the identity or authenticity of users on the platform. Artists and visitors may or may not be verified. It is your responsibility to exercise due diligence before engaging with any user on the platform.

User Responsibility & Safety

You are solely responsible for the artwork, descriptions, comments, and other content you upload, post, or share through Galleria Art. You represent and warrant that you own or have all necessary rights to publish such content under applicable intellectual property, privacy, publicity, and contract law, and that the content does not infringe the rights of any third party.

You agree to engage with other artists, collectors, and visitors in a respectful and lawful manner, and to follow our Community Guidelines. You agree not to use the platform to harass, threaten, defame, defraud, or impersonate any other user, and to comply with all applicable laws when transacting with other users on or through the platform.

Pllay may suspend, restrict, or terminate any account that fails to meet these responsibilities, in accordance with the enforcement procedures set out in the Community Guidelines. By contacting artists listed on this platform, you do so at your own risk; always verify the authenticity of the artwork and the identity of the seller before making any purchase, and never send payments without proper verification.

Restrictions

You may not use the Galleria Art platform, or any artwork or content accessed through it, to:

  • reproduce, distribute, modify, publicly display, or create derivative works of any artwork without the artist's explicit written consent, except as permitted by this License Agreement or applicable law;
  • remove, obscure, or alter any copyright notice, watermark, signature, or other proprietary marking that an artist has applied to their work;
  • use artwork in a manner that is defamatory, obscene, harassing, hateful, or otherwise objectionable, or that violates applicable law;
  • publish or upload content or materials of any kind — including text, graphics, images, photographs, or other media — that are obscene, pornographic, offensive, or defamatory, or that violate any applicable local law;
  • claim authorship of — or sell, license, or attribute to yourself — any artwork created by another artist;
  • circumvent technical protection measures, watermarks, access controls, or rate limits we apply to the platform;
  • use automated tools (including bots, scrapers, or crawlers) to access, copy, or harvest artwork, artist data, or other platform content without our prior written authorization; or
  • use the platform in any manner that materially competes with the operation of Galleria Art as an art platform for artists.

Violation of any of these restrictions may result in removal of content, suspension or termination of your account, and pursuit of any other remedies available under applicable law.

Relationship to the Terms of Service

This License Agreement forms part of, and is incorporated into, the Terms of Service. The governing law, venue, warranty disclaimers, and limitation of liability set out in the Terms of Service apply to this License Agreement. In the event of any conflict between this License Agreement and the Terms of Service, the Terms of Service control.

Termination

This agreement is effective until terminated. Galleria Art may terminate your access at any time if you breach any terms of this agreement. Upon termination, you must cease all use of the platform and any content obtained through it.
